Terms of Service

Effective date: May 25, 2026

1. Agreement to Terms

By creating an account or using The Flight Swap (“the Platform,” “we,” “us,” or “our”) at theflightswap.com, you agree to these Terms of Service (“Terms”) in full. If you do not agree, do not use the Platform. We may update these Terms from time to time; continued use after changes constitutes acceptance.

2. Eligibility

You must be at least 18 years old to create an account and conduct transactions on the Platform. By registering, you represent that you are of legal age and have the authority to enter into a binding agreement. If you are between 13 and 17 years old, you may only use the Platform with verifiable parental or guardian consent.

3. Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You may not share, sell, or transfer your account to another person.
  • You must provide accurate and truthful information when registering and when creating listings.
  • You must promptly notify us at support@theflightswap.com if you suspect unauthorized access to your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Listings and Selling

Sellers are solely responsible for the accuracy, legality, and completeness of their listings. By posting a listing, you represent and warrant that:

  • You own the item listed or have the legal right to sell it.
  • All item descriptions, photos, condition ratings, and flight numbers are accurate and not misleading.
  • The item is a genuine, legal disc golf disc and not a counterfeit, prohibited, or illegal item.
  • You will ship the item within 3 business days of payment being confirmed, unless otherwise agreed with the buyer.
  • You will honor the agreed-upon price and listing terms.

We reserve the right to remove any listing that violates these Terms or that we determine in our sole discretion to be harmful, fraudulent, or otherwise inappropriate.

5. Buying and Transactions

  • Buyers agree to pay the full listed price plus applicable shipping costs at checkout.
  • All sales are between individual users. The Flight Swap is a marketplace facilitator, not a party to the sale.
  • Once payment is submitted, buyers may not cancel except as permitted under our dispute resolution process.
  • Buyers are encouraged to review seller profiles, trust scores, and listing descriptions carefully before purchasing.

6. Platform Fees

The Flight Swap charges a platform fee on completed sales. Fee amounts are disclosed at checkout and on the seller dashboard. Fees are non-refundable once a transaction is completed. Payment processing fees charged by Stripe are separate and also non-refundable.

7. Prohibited Items and Conduct

The following are strictly prohibited on the Platform:

  • Counterfeit, replica, or unauthorized reproduction of disc golf discs or branded merchandise.
  • Weapons, illegal items, controlled substances, or hazardous materials.
  • Spam, scam listings, or intentionally deceptive content.
  • Harassment, abusive language, threats, or discriminatory behavior toward other users.
  • Circumventing the Platform to complete transactions outside of our payment system in order to avoid fees.
  • Creating multiple accounts to evade bans or manipulate trust scores or ratings.
  • Any activity that violates applicable local, state, national, or international law.

8. Shipping and Delivery

Sellers are responsible for packaging items securely and shipping them via a tracked carrier. Risk of loss transfers to the buyer once the item is delivered to the shipping carrier. The Flight Swap is not responsible for items lost, damaged, or delayed in transit. We recommend sellers retain tracking information and buyers purchase shipping insurance for high-value items.

9. Disputes and Refunds

If you have a dispute with another user, you should first attempt to resolve it directly through our messaging system. If a resolution cannot be reached, you may escalate the dispute to us at support@theflightswap.com within 14 days of the expected delivery date. We will review the evidence provided by both parties and make a determination at our sole discretion. We may, at our option, issue refunds or credits, but we are not obligated to do so. Chargebacks filed without first contacting us may result in account suspension.

10. Trades

Trade transactions are peer-to-peer agreements between users. The Flight Swap facilitates trade matching but is not responsible for the outcome of any trade. Both parties are responsible for accurate disc descriptions, timely shipping, and resolving any disputes. Trades completed outside the Platform are done at the users' own risk.

11. Intellectual Property

All Platform content, design, logos, and software are owned by The Flight Swap or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission. By posting photos or content to the Platform, you grant The Flight Swap a non-exclusive, royalty-free license to use, display, and reproduce that content in connection with operating the Platform.

12. Disclaimer of Warranties

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES. WE MAKE NO WARRANTY REGARDING THE QUALITY, ACCURACY, OR COMPLETENESS OF ANY LISTING OR USER CONTENT.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE FLIGHT SWAP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR ANY TRANSACTION BETWEEN USERS. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $50.

14. Indemnification

You agree to defend, indemnify, and hold harmless The Flight Swap and its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including attorneys' fees) arising out of your use of the Platform, your listings or transactions, or your violation of these Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of the United States. Any dispute arising from these Terms or your use of the Platform that cannot be resolved informally shall be resolved through binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction. You waive any right to participate in a class action lawsuit or class-wide arbitration.
